LOSES THE SUIT
Action to Recover Damages for Loss of Casco Is Decided in Favor of Defendant.
The Supreme Court yesterday confirmed the sentence of the lower court in favor of defendant, in the suit of Esteban Quiros vs. D. M. Carman.
Mr. Quiros, formerly a clerk in the office of the depot quarter-master, and now proprietor of a cinematograph on calle Azcarraga, sued for the recovery of the value of a caso rented to D. M. Carman, for use by the quarter-master's department, under a contract, and which caso was lost in a typhoon. The plaintiff alleged the existence of a verbal contract according to which defendant agreed to pay all losses and damages, but the court found that plaintiff knew that the casco was destined for the service of the government and that the craft of defendant, but only through fault of the crew or of the government.
Justice E. Finley Johnson disagreed from the judgment of the Court.
